The Site is operated and serviced bySportiff India Private Limitedx(“SIPL”, “we”, “us”, or “our”), a company incorporated in India with its registered office at 76 Mirza Ghalib Marg, Clare Road, Byculla, Mumbai 400008, Maharashtra, India (CIN: U92419MH2001PTC130316; GSTIN: 27AAFCS2096A1ZJ). SIPL is the authorised distributor in India for arena S.p.A., Italy (“arena”), for the Import, distribution, and sale of arena® branded swimwear, sports gear, and equipment.
These Terms of Use (“Terms”) govern your access to and use of the Site, and also apply to all purchases made through the Site. By accessing, browsing, registering on, or purchasing from the Site, you agree to follow and be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
SIPL may modify or amend these Terms from time to time without prior notice, depending on changes in law, our policies, or market conditions. Your continued use of the Site following any such change will constitute your acceptance of the revised Terms. We encourage you to review these Terms regularly. If at any time you do not agree to be bound by these Terms, you must immediately stop using the Site.
SIPL may terminate or suspend your account, delete your profile or any user content, and restrict your use of all or any part of the Site at any time and for any reason, without liability, subject to applicable law.
Any person or entity that interacts with the Site through crawlers, bots, scrapers, data-mining or extraction tools, or similar automated functionality — whether placed by such person or by a third party — is considered to be using the Site and is bound by these Terms.
“You” / “User” / “Customer” means any natural or legal person who accesses, browses, registers on, or purchases from the Site.
“Your Information” means any information you provide during registration, account use, ordering, feedback, or communications with us through the Site, email, or other channels.
“Products” means arena®-branded swimwear, sports gear, equipment, and other merchandise offered for sale on the Site.
“Contents” has the meaning given in Section 14.

All Products sold on the Site display, on their respective product pages, information including price, expiry date (where applicable), country of origin, and other particulars required to enable an informed pre-purchase decision under the Consumer Protection (E-Commerce) Rules, 2020.
Use of the Site is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872 . Persons who are “incompetent to contract” within the meaning of that Act, including minors and un-discharged insolvents, are not eligible to use the Site.
If you are a minor (under the age of 18), you may not register as a User of the Site or transact on the Site. If a minor wishes to purchase Products available on the Site, such purchase must be made by the minor’s parent or lawful guardian through their own adult account. SIPL reserves the right to terminate your account or refuse access to the Site if it is discovered that you are under 18 years of age.
You agree to provide true, accurate, current, and complete information about yourself as prompted by our registration form and during any transaction. If you provide information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect the same, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).
You may not maintain more than one account. Maintaining more than one account by the same User shall be treated as a fraudulent act and will attract the consequences set out in Section 12 (Fraudulent / Declined Transactions). You are prohibited from selling, trading, or otherwise transferring your account on the Site to any other party. SIPL is not responsible in any manner for any dispute arising out of transactions conducted by any third party using your account, e-mail, or payment credentials.
Unless otherwise specified, the materials on the Site are directed solely at persons who access the Site from India. We make no representation that any Products or services referred to on the Site are appropriate or available outside India. Those who access the Site from outside India do so at their own initiative and are responsible for compliance with applicable local laws. We deliver Products only within India and will not be liable for any claims relating to orders placed from outside India. We retain the right to accept or reject any order.
You may be required to provide your contact details — such as name, address, mobile number, and email ID — to access certain services or areas of the Site. Account access is generally provided via One-Time Password (“OTP”) sent to your registered mobile number. Your account credentials are for your personal use only, and you may not share them with any other person.
You are responsible for restricting access to your device and account and accept responsibility for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security of which you become aware. SIPL will not be liable for any loss or damage arising from your failure to protect your account, OTP, or login credentials.
The Site may only be used for lawful purposes in accordance with these Terms. As a condition of your use of the Site, you warrant to SIPL that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. Whether on behalf of yourself or on behalf of any third party, you may not:
In addition, you must comply with the obligations of “users” under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and must not host, display, upload, modify, publish, transmit, or share any information that is unlawful, defamatory, obscene, paedophilic, invasive of another’s privacy, infringes intellectual property rights, or is otherwise prohibited under applicable law.
All comments, reviews, feedback, ratings, suggestions, ideas, postcards, and other submissions disclosed, submitted, or offered to SIPL on or through the Site or by other means — including via customer care calls, email, or mail — in connection with your use of the Site (collectively, “Comments”) shall be and remain the property of SIPL. Such disclosure, submission, or offer of any Comments constitutes an assignment to SIPL of all worldwide rights, titles, and interests in all copyrights and other intellectual-property rights in the Comments, to the maximum extent permitted by law. Accordingly, SIPL will own exclusively all such rights, titles, and interests and shall not be limited in any way in its use of any Comments, whether commercial or otherwise.
SIPL is and shall be under no obligation: (i) to maintain any Comments in confidence; (ii) to pay you any compensation for any Comments; or (iii) to respond to any Comments.
You agree that no Comments submitted by you to the Site will violate any right of any third party — including copyright, trademark, privacy, or any other personal or proprietary right — and will not be or contain libellous, defamatory, obscene, abusive, or otherwise unlawful material. You are and shall remain solely responsible for the content of any Comments you submit. SIPL reserves the right (but is not obliged) to remove any Comments from the Site at any time, in its sole discretion.
You agree that SIPL may use and/or disclose aggregated or de-identified information about your demographics and use of the Site in any manner that does not personally identify you.

Except as prohibited by applicable law, we make no representation as to the completeness, accuracy, or currency of any information on the Site.
Products listed on the Site may be unavailable, may have attributes different from those listed, or may carry a different price from that displayed. We may make changes to information about price and availability without notice. All product descriptions and offerings are subject to change at any time without notice.
Despite our best efforts, a small number of Products may be listed at incorrect prices. In the event of any pricing error, we reserve the right to cancel any order containing pricing inaccuracies, regardless of any order or shipping confirmation you may have received.
Every effort has been made to display, as accurately as possible, the colours of Products that appear on the Site. However, as actual colours will depend on your screen and display settings, we cannot guarantee that the colours shown will exactly match the Product as delivered. Weights, measures, and similar descriptions are approximate and provided for convenience only.
If you wish to purchase any Product made available through the Site (a “Transaction”), you may be asked to provide information relevant to your Transaction — including, without limitation, your method of payment, billing address, and shipping information. You represent and warrant that you have the legal right to use any payment card or other payment method utilised in connection with any Transaction. By submitting such information, you grant SIPL the right to provide such information to third parties for the purpose of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to acceptance or completion of any Transaction.
While we typically send an order confirmation by email, the receipt of such an email confirmation does not, by itself, constitute our acceptance of your order. Your order constitutes an offer by you to purchase the Product(s), and we may accept or reject your offer at our sole discretion. The contract of sale is formed only when SIPL accepts your order, typically at the time the Product is dispatched.
SIPL may from time to time, at its sole discretion, reject or limit quantities on orders placed by the same individual or account, orders placed using the same payment card, and/or orders shipping to or billed to the same address. We also reserve the right, at our sole discretion, to reject any sale to, or limit the quantity of any purchase by, a reseller. A “reseller” is any individual or entity that purchases Products with the intention of reselling them to others, and not solely for personal use. SIPL does not offer additional discounts on any purchase made with the intention of resale.
SIPL reserves the right, at its sole discretion, to refuse or cancel any order for any reason, including: limitations on quantities available; inaccuracies or errors in product or pricing information; problems identified by our fraud-detection processes or by the bank or payment gateway; or any other reason. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after payment, the amount will be refunded to your original payment method as per our Refund Policy.
You may cancel your order only before the dispatch process begins (not after your order has been picked, packed or shipped) from our warehouse, by using the “My Account” section of the Site or by contacting customer care by email, on [email protected]. Once an order has been processed for pick, pack or ship, it cannot be cancelled. SIPL has the right to determine whether an order has been processed and you agree not to dispute SIPL’s decision in this regard.
arena® Products are technical, performance-oriented swimwear and equipment. You acknowledge that, before placing an order, you are responsible for satisfying yourself as to the suitability, size, fit, specifications, and intended use of the Product. The product pages on the Site contain size charts, technical specifications, and other particulars to enable an informed pre-purchase decision.
The following Products are non-returnable and non-exchangeable on hygiene and product-integrity grounds, except where Section 9.5(e) applies:
For Products that are not listed as non-returnable in Section 9.5(c), you may request an exchange (subject to availability) within seven (7) days from the date of delivery, on the following cumulative conditions:
Exchanges are subject to stock availability. Where an exchange is not feasible (e.g., the requested size or variant is out of stock), we will discuss alternative remedies with you. Promotional vouchers, codes, or coupons applied to the original order are not refundable or re-issuable on cancellation, return, or exchange.
Nothing in this Section 9.5 limits your statutory rights as a consumer under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. If a Product delivered to you is defective, damaged in transit, materially different from the Product ordered, or does not conform to the description, images, or specifications displayed on the Site, you may notify SIPL’s customer care within seven (7) days from the date of delivery with supporting photographs and your order details. On verification, SIPL will, at your option, arrange a replacement of the Product (subject to availability) or, where replacement is not feasible, refund the amount paid to your original payment method.
All cancellation, exchange, and refund requests must be initiated through the Site or by contacting customer care on [Insert toll-free / landline] or [Insert customer-care email]. SIPL reserves the right to inspect any returned Product before approving any exchange or refund and to reject requests that do not meet the conditions of this Section 9.5.
You agree, understand, and confirm that the payment information — including card details and UPI / net-banking credentials — provided by you for transactions on the Site will be correct, accurate, and used lawfully. You must use only payment instruments that you are lawfully entitled to use.
SIPL does not store any full credit-card, debit-card, or net-banking credentials on its servers. You will be redirected to a secure payment gateway or your bank’s page to complete the transaction. If we do not receive authorisation from the relevant bank, or the transaction is interrupted, the Transaction will be treated as failed and no order will be processed;
SIPL shall not be liable in any event for any credit-card, debit-card, UPI, or wallet fraud that occurs to you. The liability for any fraudulent use of a payment instrument lies with you, and the burden of proving otherwise rests exclusively with you.
All purchases from the Site are made pursuant to a shipment contract. The risk of loss and title for Products purchased from the Site passes to you upon delivery of the Products to the carrier. Specific terms governing shipping charges, delivery timelines, and serviceable areas are set out in our Shipping Policy published on the Site, which forms an integral part of these Terms. Returns, exchanges, and refunds are governed by Section 9.5 above. Nothing in this Section or in Section 9.5 affects your statutory rights as a consumer under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
SIPL’s payment partners (payment gateways, facilitators, and banks) and our internal fraud-detection processes continuously monitor activity on the Site to prevent fraudulent accounts and transactions. Users who avail of discount coupons or vouchers fraudulently, or who otherwise misuse the Site, shall be liable to legal action under applicable law. SIPL reserves the right to recover the cost of Products, collection charges, and attorney’s fees from such persons and to initiate legal proceedings against them. In the event of detection of any fraudulent or declined transaction, SIPL reserves the right to immediately delete the relevant user account(s) and to dishonour all past and pending orders, without any liability. SIPL shall owe no refund liability in respect of any such fraudulent transaction.
The Site may contain links to, or interactive functionality with, third-party websites, including social-media platforms. SIPL is not responsible for, and has no liability in respect of, the functionality, actions, inactions, privacy practices, privacy policies, terms, or content of any such third-party website. Before enabling any sharing functionality of the Site to communicate with any third-party site, or otherwise visiting any third-party site, you are strongly advised to review and understand the terms, privacy policy, and information-sharing practices of that site. The presence of such links or interactive functionality does not constitute an endorsement by SIPL of any third-party site. Other sites may link to the Site with or without our authorisation; we may block any links to or from the Site. Your use of third-party websites and resources is at your own risk.
Unless otherwise indicated, all materials on the Site — including images, illustrations, designs, icons, photographs, video clips, audio, written content, page layouts, software, code, and other materials (collectively, the “Contents”) — are copyrights, trademarks, trade dress, and/or other intellectual properties owned, controlled, or licensed by arena S.p.A., Italy, SIPL, and/or their respective affiliates and licensors. The collection, arrangement, and assembly of the Contents is the exclusive property of SIPL and arena and is protected under all applicable laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999 of India, as well as international copyright and trademark laws.
All rights not expressly granted are reserved. You may not modify any part of the Site or the Contents. No portion of the Contents may be reprinted, copied, or republished in any form without our prior written permission. You may, however, download and copy items such as store locations or product descriptions for your personal, non-commercial use only. No right, title, or interest in any downloaded material is transferred to you as a result of such downloading or copying.
You may not reproduce (except as expressly permitted above), publish, transmit, distribute, display, modify, create derivative works from, sell, or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software.
arena® and all related logos and trade dress used on the Site are trademarks of arena S.p.A., Italy, used by SIPL under licence / distribution arrangements. All other trademarks, product names, and company names or logos cited on the Site are the property of the respective third-party owners.
Parental-control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material that is unsuitable for minors. SIPL does not endorse any specific such product or service.
Your privacy is important to us. The collection, use, storage, sharing, and protection of your personal data through the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read, understood, and agreed to the Privacy Policy. Personal data is processed in accordance with the Digital Personal Data Protection Act, 2023 and rules made thereunder.
SIPL does not represent or warrant that the Site or its server will be error-free, uninterrupted, free from unauthorised access (including third-party hackers or denial-of-service attacks), or otherwise meet your requirements.
THE SITE AND ALL CONTENTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. YOU ACKNOWLEDGE, BY YOUR USE OF THE SITE, THAT YOUR USE IS AT YOUR SOLE RISK, THAT YOU ASSUME FULL RESPONSIBILITY FOR ALL COSTS ASSOCIATED WITH ANY SERVICING OR REPAIRS OF EQUIPMENT YOU USE IN CONNECTION WITH THE SITE, AND THAT, SUBJECT TO APPLICABLE LAW, SIPL SHALL NOT BE LIABLE FOR ANY DAMAGES RELATED TO YOUR USE OF THE SITE.
Nothing in this Section limits any rights you may have under the Consumer Protection Act, 2019 or other applicable consumer-protection laws of India that cannot lawfully be excluded.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIPL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, INCOME, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PURCHASE MADE THROUGH THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT SIPL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SIPL’S MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH A PARTICULAR ORDER SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN RESPECT OF THAT ORDER.
Nothing in this Section limits any liability of SIPL that cannot lawfully be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability under the Consumer Protection Act, 2019.
You agree to defend, indemnify, and hold harmless SIPL, arena, and their respective shareholders, employees, directors, officers, and agents from and against any and all third-party claims, damages, costs, liabilities, fines, penalties, and expenses, including reasonable attorney’s fees, arising from or related to: (i) your breach of these Terms; (ii) your violation of any applicable law or third-party right; (iii) your use of the Site; or (iv) any purchase made through the Site that is attributable to your acts or omissions.
Neither SIPL nor you shall be responsible for damages or for delays or failures in performance resulting from acts or occurrences beyond their reasonable control, including, without limitation: fire, lightning, explosion, power surge or failure, water, acts of God, pandemic, epidemic, war, revolution, civil commotion, acts of civil or military authorities or public enemies; any law, order, regulation, ordinance, or requirement of any government or legal body; labour unrest (including strikes, slowdowns, picketing, or boycotts); inability to secure raw materials, transportation, fuel, or energy; or acts or omissions of common carriers.
For details on notices, the designated Grievance Officer under the Digital Personal Data Protection Act, 2023 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the resident Nodal Officer designated under the Consumer Protection (E-Commerce) Rules, 2020, please refer to our Privacy Policy published on the Site.
SIPL may terminate these Terms at any time. Without limiting the foregoing, SIPL has the right to immediately terminate your account or block your IP address in the event of any conduct that SIPL, in its sole discretion, considers unacceptable or in breach of these Terms.
You may terminate your acceptance of these Terms at any time by discontinuing all further use of the Site.
Notwithstanding any other provision of these Terms or any general legal principle to the contrary, any provision of these Terms that imposes or contemplates continuing obligations on a party — including, without limitation, those relating to intellectual property, Comments, confidentiality, indemnification, limitation of liability, governing law, and dispute resolution — will survive the expiration or termination of these Terms.
In the event of any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination (a “Dispute”), the parties shall first endeavour to resolve the Dispute amicably through good-faith discussions. Either party may initiate such discussions by sending a written notice to the other party setting out the nature of the Dispute.
If the Dispute is not resolved within thirty (30) days of such notice, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator, mutually appointed by the parties; failing such mutual appointment within thirty (30) days of a written request, the sole arbitrator shall be appointed in accordance with Section 11 of the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Mumbai, Maharashtra. The language of the arbitration shall be English. The arbitral award shall be final and binding on the parties.
Nothing in this Section shall prevent either party from seeking interim or injunctive relief from a competent court at any time, or from limiting any statutory rights available to consumers under the Consumer Protection Act, 2019, including the right to file a complaint before the appropriate consumer dispute redressal commission. Consumer statutory rights, including the right to participate in class complaints under that Act, are expressly preserved and are not waived by these Terms.
The Site is displayed for the purpose of promoting arena® Products and SIPL’s services available in India. The Site is controlled and operated by SIPL from its office in Mumbai, Maharashtra. These Terms, all advertisements and offerings on the Site, and all purchases made through the Site shall be construed and governed in accordance with the laws of India, without regard to any conflict-of-laws principles. Subject to the dispute-resolution mechanism in Section 23, the courts at Mumbai, Maharashtrashall have exclusive jurisdiction over any matter arising out of or in connection with these Terms.
If any provision of these Terms is held to be invalid or unenforceable under applicable law (including, without limitation, the warranty disclaimers and liability limitations set out above), the invalid or unenforceable provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in full force and effect.
Unless otherwise specified, these Terms, together with the Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any other policies published on the Site, constitute the entire agreement between you and SIPL with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Site.
SIPL’s failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. SIPL may assign these Terms, in whole or in part, to any affiliate or successor-in-interest without your further consent.
These Terms have been drawn up in English. In the event of any translation, the English version shall prevail.
